Shares of Microsoft (Nasdaq: MSFT) bumped up after an analyst implied that the United States Supreme Court would soon decide whether to hear the company's antitrust suit.
In a conference call with his sales force, Deutsche Banc Alex Brown said that a "senior Department of Justice official" told him the court could decide whether or not to hear Microsoft's appeal as soon as September 8. Many speculated the court might decide whether or not to take the case this season.
Microsoft was up 1.063 to 71.063 in morning trading.
"It is our continued opinion that the case will be heard by the appellate court," DB analyst Christopher Mortenson said.
Microsoft has asked to have the case returned to a lower appeals court, while the US Justice Department has sought a hearing at the high court. Even if the Supreme Court does hear the case, it is unclear when that hearing would take place.
