TIO moves on dumpers

The Telecommunications Industry Ombudsman (TIO) has received over 60 complaints against Australian Internet Billing, a company believed to be practicing "Internet dumping".

The TIO sent two of its staff to the offices of Australian Internet Billing on Tuesday after complaints were made by dial-up Internet users who received invoices from the company. Some of those billed are understood to have claimed they had never heard of Australian Internet Billing until they received the invoices. However, because the TIO is a member-funded regulatory body that Australian Internet Billing is yet to join, it cannot take any direct action against the company. The office of the TIO now says Australian Internet Billing must join its membership; its failure to do so would likely constitute a violation of the Telecommunications Act, according to TIO company secretary Phillip Caruthers.

Internet dumping is the controversial practice of leading dial-up Internet users to run a small program -- often executed when the user clicks the "yes" button on a pop-up window when online -- which disconnects them from their Internet service provider and causes their computer to dial in to a "premium" Internet service, which is often billed at a rate of several dollars a minute. Internet dumpers get around fair trading and trade practice laws by detailing terms and conditions in the pop-up windows, which users frequently ignore or fail to read carefully before agreeing to run the program.

"They click on 'do you want to see porn', their machine drops their connection to their current ISP, and takes a line... to Australian Internet Billing Pty Ltd and then that line is then connected to the Internet and provides access to the service. The service that they're providing that makes them an ISP," Caruthers explained. Because Australian Internet Billing acts as an ISP, legislation dictates the company must join the TIO, he added.

Dumping was highlighted by the ombudsman as a major issue for telecommunications regulators during an interview with ZDNet Australia last year.

"The fastest growing area of billing dispute over the last 12 months has in fact been dumping complaints," Pinnock said. "If you talk to anyone in a regulatory area... this is one of the biggest issues that has been brought to the fore in policy terms."

It's an area that Pinnock says is difficult to police.

"First of all you've got to show that there's an intention to defraud, or an intention to deceive, and that's not always easy. The other thing is even if the [dumping] site puts people on notice, there's still the issue of over-commitment, where essentially the carriers are acting as sorts of credit providers, even though they're not," he explained.

The TIO can, however, impose fees on its members. If Australian Internet Billing is forced to become a member of the TIO, the telco body will have the authority to invoice the company for complaints made against it. The fee for a complaint varies, Caruthers said, depending on "how easily they're solved". The TIO has in the past taken action to wind up companies using its leverage as a creditor, when member organisations have failed to pay their bills.

    I received a bill from Australian Internet Billing in February for services in January. I rang them and they informed me it was for porn. When I told them I hadnt accessed any porn and I can only think that my kids may have done it they told me I had an obligation to watch my kids when they were on the internet. I then went home to throttle my kids only to find out that they didnt know what I was talking about. AIB told me I would have to pay their bill. I didnt. They told me they would chase them up. They didnt. It is now May and I havent heard from them. I found it very interesting that the name on my bill actually had both mine and my husband's name, when actually my phone account is listed only in my name! Go figure???? - I wonder if they are getting our numbers from the phone book where both our names are listed?????

Downloads that need your imformation so you can access that site (Legitimate site).     A friend of mine received a bill in the mail recently from Approach Telecom asking for $110. She isnt well versed with computers but put me on the phone after the people at Approach refused to help her - they wouldnt even tell her what site that she had allegedly accessed - stating it was against the law for them to tell her. I went on and spoke to them, I know a bit more about computers and once I proved I knew what I was talking about and that I knew they were full of it, and I would not budge, he agreed to clear my friends account.     Today I, too, recieved a bill for $115.50 from "approach TELECOM" for services which I most certainly did NOT request or agree to. When I called the "company" (and I use that term lightly)
    to dispute the debt, and was actually told to "MAKE THEM AN OFFFER" to clear my account! Gobsmacked, I asked the young man why I should do a thing like that, he said that it would be easier on all concerned if I gave them $50 to cover their costs. I am extremely angry and I am NOT paying them a cent. What worries me is that they might ruin my credit! This kind of behaviour is reprehensible, and should not be allowed to continue.

    Basically to get out of it, ring the ombudsman, make a complaint. Get a reference number.
    Then ring approach, ask to speak to a supervisor and explain you have made a complaint to the ombudsman and that you don't believe you should have to pay the bill.

    Ring the TIO and lodge a compliant. These people are scum. Nothing more, but probably much less. They don't deserver to breath let alone run this sort of scam.
    Ring the TIO, make a complaint, then ring approach. They will drop the charges because they know they don't have a hope in hell of winning in a court of law. If they wish to still charge you, then take them to court. You should be able to win easily.

    A relative of mine has recently received an invoice from Approach Telecom Pty Ltd for 'services rendered. My relative has no recollection or knowledge of any services rendered by the above company.

    The approachtelecom website states that:

    A large number of websites use the same internet dialers and special telephone numbers so it is not possible to say which one was accessed. Approach Telecom provides the ability to make the telephone calls but does not provide the content.

    As this company is a wholly owned subsidary of Quadrant Iridium Limited I would suggest that if you have received such a invoice, and have no record recollection or knowledge of the services rendered, that you email or write to the Company Secretary, Mr Phillip Macleod at, PO Box 507 WEMBLEY WA 6014, and bring to his attention this obvious deficiency in his Company's accounting system, and request full details of the services rendered. I would ask if it is good business practice to charge for services without actually identifying such services, especially when fully details are requested. Sending a copy of letter your letter to your relevent state or territory fair trading organisation, local member and the Federal Minister for Telecommunications (Senator. The Hon. Helen Coonan)would be highly appropriate. As would asking several of your friends and relatives to write to Mr MacLeod asking him the same questions.

    I have just dealt with this company in relation to a bill which I recieved. I had no knowledge of this company so I did am ASIC search and rang the Telecommunications Industry Ombudsman for advice.

    The bill happened when my partner was house sitting and using my computer and he said he recieved an email and he opened it and a blank screen appeared. He ignored it and 3 weeks later a bill arrived of $99.

    I am happy to report that the TIO contacted AT on my behalf and they rang me back within 1 hour saying that they shall cancel the bill. Maybe others could adopt this approach when dealing with this and other companies.

    I cannot complain about AT as they have done the right thing by me and I am also impressed in the immediate action taken by TIO.

    I am somewhat perplexed & slightly amused by the unexpected arrival of this account. At first I thought to file it vertically, and treat it with the disrespect I believe it deserves, but on second thought I decided to investigate, because the issue interests me from a legal point of view and in regards to my ability to navigate the Internet in the (brave new) world of tomorrow. It has for a while been obvious to me that The Internet is here to stay, and that people like myself will be more or less forced to use it for business purposes. And that The Internet also has its recreational, as well as educational uses.

    As a fat, middle-aged disillusioned Business Proprietor, Company Director and Senior Partner in a small, but thriving business, I enjoy some standing in the local community and so does my business. I have a lifelong experience in legally binding contracts and know a fraction about The Privacy Act.

    Now, I do not recall having expressly and in writing (with a hard copy for myself), given to your company the permission to supply ‘Internal Data’ via a contact number that does not mean the least to myself. Nor do I recall having seen my signature to this effect? Should this data by some miracle be porn between consenting parties of age, then kindly send me per mail on, say CD rom or floppy-disk, a sample of, what it is you wish me to pay for. Should the ‘data’ thus supplied ring a bell on close scrutiny, you shall be paid indeed!

    Bearing in mind that I do not believe that you may execute per email, only act, to begin with I do not believe that what we have here is a legally binding contract between the parties. My wife does not recall either, to have collected ‘international data’, and I frankly doubt that she would know how to, using our computer. Her sex-life has not recently become more adventurous, either, nor has she become noticeably wiser, that I can detect? This raises the interesting question, to whom in my household you may have supplied the allegedly ordered data. We have two children, both
    under the age of consent. If you have supplied porn to minor(s) I believe that the whole issue could become rather troublesome, and does indeed a court ruling exist that a parent or email

My progeny (who are both computer savvy, contrary to their parents and without a doubt have a sound curiosity about sex) deny having used a dial-up service, but so would they, if we are talking about (strictly educational, understandably?) porn. However, I recall and openly admit, that upon several occasions since connecting to Telstra Broadband, have I heard my computer, which I have named ‘Antichrist II’ dial up to someone in cyberspace, while I have been working elsewhere on it. Why, I do not know; where it went and for how long, I do not know, either. I wonder what else may lie in store for me here, in the vaults of this busy computer-do-it-yourself busy-bee?

    I find, however, reading on The Internet (having searched for your company’s physical address with the view to paying you a visit in person) about the operation(s) of your company that indeed many interesting comments and issues of potent and relevant interest to our community as a whole, have been raised here, and that also The Ombudsman (Telecommunications) have points of reference and significance to add to this unfortunate saga.

    Hence, I’m not prepared to let the matter rest, and urge you to re-consider your bill, or go about the matter to convince me to pay in a mutually satisfactory manner, perhaps as politely requested above.     I have also received a bill from "Approach Telecom". This is the first time ever I heard of this company. I have no dealings with them or signed up any paperwork with them, how can I then be liable for the bills they have sent me? Under privacy law they need to get the details from the subscriber. Directors are Michael Denis Boyd and Michael Abela. Owned by Quadrant Iridium Limited(a publicly listed company on the ASX). Do a google search on any of these people / companies for more info. Don't just speculate on who is behind this business, do your research and send your concerns direct to them.

    I too have received (2)bills from Approach Telecom. The first one was for $140.00 which I paid (believing it to be a legitimate company). Since finding this site I have received another bill for $11.00. I did not give anyone permission to redirect my internet connection. Since finding this site I am now not sure whether to pay the bill or not. As far as I can tell the web site for approach telecom does not exist. Can you advise me what my legal standing is.

My Solicitor said not to pay them because they are not a legitimate contract and they have no recourse to you, other than cutting of your service with them, which no one wants in the first place!     I've just recieved a bill from Approach Telecom too. My wife rang me at work in a very annoyed state to tell me about this bill for $82.50. I think she was convinced that I was some pervert paying for porn. I rang the company to complain and explained that I had not accessed any of their services. When I said that I was going to take it further they said they would clear the bill for me. I doubt that any legitimate company would be so quick to waive a bill. This company is obviously just an opportunistic bunch of criminals. I intend to complain to the ombudsman about this company.

    Hey all, a HUGE thanks to everyone who has posted comments on the Telephone Dumping trash company called "Approach Telecom". My friends received an invoice for over $1300, which they hit the roof!! The invoice was very clever indeed, it included a cover letter showing how `kind' they were by reducing the bill to $330, and that all future bills would be capped to that maximum, they included all formal letterhead with a back page explaining your rights, they gave a phone number to call if you have any queries, and the phone number to the TIO. When I called them today, they answered their calls as "Hello" or in following calls they would just pickup the phone and give no introduction and no name of the operator, unless of course you asked for it. I said that I wanted to speak with the supervisor and got `Mary', when I asked for a reason for the invoice, she immediatley barraged me with (obviously a prepared speach because she barely left room for a breath) about how we had agreed to the `terms' and that `everytime' we connected to their service an agreement had to be entered manually for every connection, and that the system had recorded this, so we were billed for each usage. interesting I said, considering no message ever appeared, yet their trojan installation program was loaded into the system as Hot_Tarts and Hot_Virgins, the default webpage was set to their network and that meant even if you didn't want to connect to them at $5 per/min it would anyway. She gave me an additional barrage of info about these conditions HAD to be agreed to, and every connection prompted the user to agree to it, and as evidence in the Windows\Temporary Internet Files directory was a record of the connection time, including a file from them showing the `agreed' connection... so, I powered on the computer and went there.. suprise, suprise - NO AGREED connection documents, but additionally all the times that Approach had invoiced me had NO INTERNET USAGE anywhere near the stated time!!! She refused to believe me, so we went through the Temp Internet Files directory for EVERY listing on every day and in one day particularly it showed a bill for $610 yet during the entire timeframe the computer never even dialled out. Consequently all charges were immediatley dropped, gee that was nice of them considering that they could not prove a single charge was geniune in an entire $1300 invoice. Here is my recommendation when you get an invoice from them:
    1) Don't panic, their records are rubbish
    2) Don't blame your family for porno use, this company exploits a trojan installation that is 90% silent or hidden behind a pop-up window
    3) Calmy, power on your computer and compare the Windows\Temporary Internet Files directory and sort by last accessed column for date of use
    4) Compare their bill to your usage and see exactly what timeframe you were using your computer, if their records are not within 10mins of your folder then that entry is invalid
    5) When you have proven that their invoice is a fake, contact them and demand to speak with a supervisor, open Word and type the Time, Date, Phone number, who you are speaking to and what is suggested in resolving the invoice
    6) When they have cleared the invoice, demand that they block your phone number from their system, incase the trojan tries to get you again, contact your home phone company and get all premium numbers banned from your home phone.
    7) Contact TIO and lodge a formal complaint about receiving the invoice in the 1st place and if need be, contact the Police and complain about the invoice being Fraud !

    Any attempt to demand money from a service not requested or supplied is FRAUD, and should be reported to the police. For me, I am contacting the TIO first then the Police Computer Fraud department shortly.

    I received a bill from Approach Telecom in February for a connection apparently made in January. On the same day my neighbour received a bill for a similar connection in December 2004. His bill had been placed in my letterbox as there were no unit numbers in the address. We have never knowingly accepted the "premium services" provided; his family were on holiday at the time in question and I was not on-line then.

    I suspect our names were lifted from the phone directory which does not have unit numbers listed. When I rang Approach Telecom to query the bill, the woman on the line said, rather quickly, that she would cancel the bill as I was disputing it, and proceded to do so without knowing my name or any details apart from the amount on the bill. I could hear the clicks of her computer keyboard as she searched for the amount stated and cancelled the bill. When I asked how she could possibly cancel a bill without knowing any other details, she said she had merely noted my request and tried to backtrack and ask for the account number or my name, in order to cancel it. All in all a rather suspicious interaction, and I have made a complaint to the TIO.

    Evidently, domplaints to watchdogs may not be sufficient given that such practices are still continuing. In addition to other formal avenues of complaint (local and federal MPs, letters to newspapers etc) I am considering sparing $5 or $10 of this disputed bill towards a dumping in kind, by sending them all the junk mail that comes through my mailbox. Perhaps if they are flooded with such mail they will rethink their practices. Any other ideas for getting even?

    Ive also recieved a bill from approach, it turned out to be my Mr nobody boyfriend. I spoke to Lee at the callcentre and he was excellent. He explained clearly how to find the information I required and enabled me to track down the culprit who used these services without my knowledge. I'd like to say a huge thank you to Lee for this and although this company is in a difficult position given the industry they are in... try getting the same response from telstra whom billed me for the same type of thing last year. Approach although I didnt appreciate the bill were informative and helpful which T are not. Thanks Lee and please anyone with further questions call first thay are happy to help and althought it may fall on deaf ears they DO actually help.

    I too received a bill from Approach Telecom and have no idea what the bill was for. There was no Last name on the bill which I thought was quite strange.When I rand and questioned what web site it was for they told me they could not. This was my first point of concern, they then told me to chech my temp. interent folder and see what web sites i visited and match up the dates with the invoice. Surprise surprise none matched up. I rang the TIO and made a complaint.

    Surprise Surprise. I too received a bill out of the blue last Friday for $170- for supposedly usage of a site I have no idea of. The icon for Hot Tarts loaded itself firmly on my desktop and everytime we would uninstall it, it would re-appear the next time we logged back onto the net. The time Approach Telecom advise us of accessing the sit there was no one at home. Not for at least two hours was the first arrival of anyone at home. My biggest concern is that this icon was in full view of my three children all of whome are well under 18. Initially Approach werer insistant that we were required to pay the bill but left the onus on me to find out what site was accessed(??) I contacted the TIO who requested I contact Approach and have them provide detail of which site was accessed. When the call was made to Approach they cleared the account simlply from the fact that I stated my account number and the reference number from the TIO. No further questions asked. If you ever receive a bill from these people, unless you have accessed the site, don't pay. Go straight to the TIO and lodge the complaint. This is the only way to stop these unscrupulous operators. And don't blame any of your family members for accessing porn. They may very well be innocent.

    Here is a suggestion in dealing with Approach Telecom - simply return the courtesy by sending an invoice for your own time and effort. I did this recently and informed them they are liable for costs incurred because they, or at least someone in their organisation, "must" have accessed my details erroneously, and then sent an invoice. Naturally I explained to them that by sending me an invoice in the first place, it clearly demonstrates they accepted and agreeed to "my" terms and conditions. I went on to helpfully suggest that it could have been 'anyone' in their office, perhaps a cleaner, neighbour or rogue collegue - it makes no difference, they are still liable for my time. Then there was the costly process of finding an envelope, stuffing their invoice into it along with my own, then travelling to a post office. After a careful study of helpful hints offered on their web site, I thought it appropriate to also request they refrain from sending me any registered post, and that cash, credit card or cheque payment is acceptable. The reason for this is because I work for a living and may not be home to sign for such a letter. Oh - one more thing - I felt it important to advise Approach Telecom that failure to pay on their part will result in my immediate termination of my good services. Hey -what do you mean 'unfair'? I worked really hard reading their invoice and keeping a straight face. I even threw in some bonus free time because I think I might have read it twice, can't be really sure though so I thought a demonstration of my good faith was appropriate. I ****ured them I would not try and scam them for time I did not spend reading their rubbish. Nice try Approach Telecom!

    My bill was for $3683.00. I tried for days to get the trojan virus off my computer. I'm not that IT literate. Hot Tarts were everywhere.
