The Federal Court has adjourned the latest hearing of PC seller info4PC, which is being investigated for fraud, on the basis that the company's general manager hands over his passport. Today's motion before the court in Perth related to injunctions taken out last week against James Rae conducting certain financial transactions. This followed investigations by the Australian Competition and Consumer Commission, which alleged about AU$300,000 had been transferred from the company's bank account to accounts in Spain. The ACCC had earlier brought action against info4PC for contravening the Trade Practices Act by advertising cheap PCs over the Internet and failing to fulfil 3000 orders that were paid for up-front. The consumer watchdog has also filed a motion for contempt of court against the embattled PC seller for continuing to advertise its cheap PC deal, despite an injunction refraining the company from doing so. Following undertakings from info4PC GM James Rae to hand over his passport and agree not to sell his house, today's motion has been adjourned until March 22, according to the ACCC. However, info4PC will be due back in court on March 1 for a further hearing regarding its position over allegations it contravened the Trade Practices Act. Last week, info4PC turned up in court without a solicitor, its previous solicitor having handed back the brief unexpectedly at the last minute. The ACCC confirmed that the PC seller was represented in court today, independently from James Rae. The ACCC alleges that info4PC cannot meet its obligations to customers. info4PC was not available for comment.
