Telstra access price hike thwarted

Telstra's legal challenge to the prices set by the Australian competition watchdog of access to its copper network was last Friday rejected in the Federal Court.

The 14 proceedings that were dismissed related to the price Telstra wanted to charge for its Line Sharing Service (LLS) and Unconditioned Local Loop service (ULLS) on its copper Customer Access Network.

LLS allows a secondary provider, such as an ISP, to provide non-voice services, while ULLS refers to both voice and internet services. Telstra had disputed the prices for each service previously set by the Australian Competition and Consumer Commission (ACCC). Respondents to Telstra's legal claims included Agile, Adam Internet, Primus, TPG, Amcom, PowerTel and Optus.

Justice Lindgren found that Telstra had misconstrued elements of the Trade Practices Act and methods used to calculate the cost of providing such services. Telstra was ordered by Lindgren to pay court costs.

"This is yet another failed attempt by Telstra to overturn an ACCC decision with a view to setting ridiculously high prices for access to its network. Telstra failed before the ACCC and now the Federal Court," Maha Krishnapillai, Optus' director of government and corporate affairs said in a statement.

"The cost of basic access to the last copper mile is a simple and clear cut issue — and yet Telstra has gamed, delayed and litigated around the issue for 12 years."

    I have so much hate for this company. I know that they have a business to run and they want to make money but they have alienated so many people with their behaviour. There must be a lot of people like me who do all they can to not use their services because of their behaviour. It's just the same old storey, they use their market dominance to restrict competition rather than provide better services and innovation.

    Hooray for the courts... finally doing something to protect us from blatant profiteering by Telstra.
    If Telstra spent the money it wastes on countless malodious law suits on innovation then the Australian telco market would be better for it. Telstra has more in-house lawyers than any other company in Australia and has relations with most of the large law firms in Sydney. It sees litigation as an acceptable form of competing. Not exactly ethical...

    Telstra is good at network engineering and innovation. Their NextG network is second to none, their adsl2+ network is top notch and they've moved to an IP core. Innovation and engineering are not Telstra's problems, CRM and product development are. There is hope though, with the new iphone now available on an attractive cap plan that now competes with Optus. Telstra's management moto should be "More competition less litigation."

    We only have the vendors word (and their dodgy maths) that an IP core is more efficient than other backbone protocols. I'm interested to see long term figures of availablity and throughput for IP core networks that have not been doctored by maarketing departments. I know I'm still stuck in the ATM mind set but for quality, efficiency and reliability I have yet to see a better transport protocol.

    From most reports I've read over these pages from those in Singapore, Korea & Japan your statement is wrong. Perhaps you're none other than the evil Telstra supporter Sydley himself?

    Telstra spends more time creating enemies than it does progress. If Telstra were to do something like what you supposed then the rest of OZ would be all for it but they don't. Even the crushing failure of Sol seems to have changed little of their behaviour so far.
