One.Tel execs still in the firing line

The Australian Securities and Investments Commission (ASIC) has flagged that it may commence substantive proceedings against four people connected with failed telco One.Tel.

A spokesperson for ASIC confirmed it had flagged substantive proceedings against former One.Tel officers Brad Keeling, Jodee Rich, Mark Silbermann, and against former chairman John Greaves. However, the spokesperson would not give any indication of what those proceedings might entail.

In September ASIC obtained undertakings by the court which prevented Jodee Rich, Brad Keeling and Mark Silbermann from transferring assets out of Australia without consulting ASIC, and also imposed travel restrictions. These undertakings remain in force until Friday.

The ASIC spokesperson said its overall investigations would be continuing. In September ASIC chairman David Knott had indicated that it would be attempting to conclude its investigations relating to issues of market disclosure and governance (duties of officers and directors) prior to the expiry of the restraining undertaking which is due to end on Friday, so that any decisions about the commencement of proceedings could be made before that time.
