Union loses fight to reinstate Optus workers

Union officials have lost the battle to have 561 sacked Optus workers reinstated but may look to take unfair dismissal action against the country's second largest telco.

-The Commission hasn't ordered the reinstatement of the employees, however it has ordered that Optus provide all information relating to the process for selecting the employees and also on their Optus Resource Centre, which looks at redeployment opportunities," Communication, Electrical and Plumbing Union (CEPU) organiser Mark Brownlow told ZDNet Australia.

Optus has to provide all the information to the Union within 10 days. -So we welcome that decision," Brownlow added.

When Optus retrenched 561 staff effective November 21, the Union raised concerns about the selection process and demanded full disclosure of how staff were targeted for retrenchment. Following Optus' failure to fully reveal its retrenchment process the Union took the matter to the Australian Industrial Relations Commission.

The Union also voiced its concerns that the week employees were given to find redeployment within the company was insufficient time.

"Now we're looking at what we can do for individuals and if they wish to take other action against Optus," Brownlow said.

The CEPU told ZDNet Australia in a previous interview that if workers weren't reinstated, it would look to take unfair dismissal action on behalf of individual workers.

Optus said will comply with the Commission's orders to provide the relevant information to the Union.

-We've provided a great deal of information to our employees and we're more than happy to provide information to the Union," an Optus spokesperson told ZDNet Australia.
