Ombudsman in workplace disagreement with Telstra

    I was forced to sign an AWA Anonymous -- 06/12/07

    The agency I was using for contracting to Ericsson on a Telstra project forced me to sign an AWA. I refused and when the next contract renewal came up it was only for two weeks and again I was forced to sign an AWA. I refused and guess what - no contract and no job.

    My original contract was a simple common law contract, the AWA being offerred had no extra or less benefits. I don't know why I was being pressured to sign it.

    My original contention is that there was no obligation to sign an AWA which worked against me by only being offerred a short two week contract renewal when my non AWA contract expired.

    But there is a bigger picture working here. The previous contractor doing my job who had left on his own accord over a year ago wanted his old contracting job back. He was mates with some of the Ericsson managers.

    When the original AWA offer was made a rumour was started by Ericsson management that I wanted to leave the job which was false. They knew that the two week offer with AWA was most unappealing (The Ericsson managers were in collusion with the agency representive at Robert Walters). And thus the managers pal got back his job.

    I hasten to add that a lawyer representing Ericsson called 6 months later saying he had a job for me.

    Huh? This is highly unusual.

    In additon to above the contract is also offered to staff on already AWA 2 year contract to extend up to 5 year.

    so in theory they have no choice rather than signing that contract

    because the thing is it has been told there is not any gaurantee that you will get job after finishing of the existing 2 year contract if you dont sign the 5 year.

    no doubt its not a forcefull

    but there is fear of losing the job after you finishing the existing contract of 2 year
