auDA has issued another consumer alert about a deceptive mail-out to Australian domain name holders by Domain Names Australia, possibly breaching undertakings given to the Federal Court.

The mail-out warns holders of Australian domain names that the net.au version of their domain name is available or unregistered. auDA (the au domain administrator) is concerned the letter could be easily mistaken for an invoice, and for this reason claims it is deceptive.

Domain Names Australia is a company controlled by Chesley Rafferty, who is also a director of Internet Registry, which has also raised ire with deceptive marketing practices.

auDA took legal action against Rafferty and Internet Registry last year -- a case which was referred to mediation -- and Rafferty gave several undertakings in the Federal Court. auDA is convinced this latest mail-out is in breach of some of those undertakings, and said it will pursue the matter vigourously.
