1. Binding Terms
If you enter the award, you are bound by these terms. By entering a product in the ZDNet Australia and CeBIT 2007 Emerging Technology Innovation Award (the Award), you are entering into an agreement with CNET Networks Australia and Hannover Fairs Australia ("ZDNet Australia and CeBIT" or "we") on the terms set out below.
2. Eligible Products
You can only enter a product in the Award if:
(A) The product or service is under 18 months old as of 1st March 2007.
(B) The language used in the product or service is English or, if it is a multi-lingual product, there is a full version or translation of the product or service in English.
For the avoidance of doubt:
(C) You may not enter a product or service which is a prototype, an electronic proof of concept, or which has only been released in beta form. Product or services that are publicly/generally available and have had a prior alpha release are eligible for entry.
(D) You may not enter a product or service, an earlier version of which was served, available or used unless the product or service you wish to enter is substantially and materially different from that earlier version.
(E) You may not enter a product or service which requires us to come to you or to a third party to judge it.
(F) The product or service submitted must be produced or provided by a company confirmed as an exhibitor at CeBIT 2007.
3. Submitting an Entry
All entries must be submitted via the entry form on the CeBIT 2007 Web site.
You should submit the following information and material in relation to each product or service you are entering in the Award at the time you enter:

You are able to submit information to support your entry. This can include client testimonials, case studies, financial reports, product images and specifications.
ZDNet Australia and CeBIT will not accept entries that do not comply with point 2 or are in formats other than those set out in clause 3.
You will need to complete a separate entry for each product that you enter into the competition if you intend to submit more than one entry.
Automatic Nomination
The CeBIT and ZDNet Australia team offer editorial and reviews on as many emerging technology innovations as possible. If, during this process, we identify an emerging technology innovation that is less that 18 months old from 1st March 2007 that we believe might be a worthy contender for an award they will be automatically shortlisted. Organisations are encouraged to nominate technologies that might be of particular interest.
4. Your Status
A company is taken to be the creator or developer of a product or service if it directly supervised and managed the overall creative and technical design and development of the product or service, and it used skills of employees or freelancers, even if it sub-contracted some elements of the product or service.
A company is taken to be the publisher of a product or service if it has distributed or made available the product or service to the public, and may have either internally developed the product or service or commissioned and/or collaborated with an independent developer. Where an entry involves an independent developer for a significant proportion of the production (over 25% by development effort (in hours or days), or responsible for key creative and technical contribution), the entry should provide credits to the independent developer.
If two or more parties jointly developed the product or service, the entry should be in the joint names of the developers involved.
5. Exclusion of Entries
ZDNet Australia and CeBIT may exclude your entry in certain circumstances. We may, at any time, exclude your entry from the Awards if:
(A) Your entry does not comply with the clauses in this document.
(B) Your entry was received after the closing date for award entries, unless we extend the closing date.
You agree that ZDNet Australia and CeBIT’s decisions and agreements relating to this award are final and correspondence will not be entered into.
6. The Judging Process
(A) During the judging process, all entries will be held in confidence and ZDNet Australia and CeBIT 2007 Emerging Technology Innovation Award judges agree to a code of confidentiality during this time.
(B) Entry information shall be viewed by the judging panel only. However, information from the winning entry and information from entries deserving an honourable mention may be shared publicly when these are announced.
(C) ZDNet Australia and CeBIT will arrange for the judging of entries of the Awards in accordance with judging criteria developed by ZDNet Australia and CeBIT. You agree that the decision of ZDNet Australia and CeBIT and/or the Award judges is final in all circumstances, and ZDNet Australia and CeBIT will not be obliged to supply you with any information about the judging of your entry.
(D) The judging panel will consist of ZDNet Australia editors.
(C) The Award judges will select up to five finalists. We will notify companies / entrants if they have been selected as a finalist, and we will announce the names of the finalists at the ZDNet Australia and CeBIT 2007 Emerging Technology Innovation Award presentation ceremony.
(D) If a company / entrant is selected as a finalist, they agree to supply us with a video compile of highlights of the relevant product for use at the Awards presentation ceremony if we ask you to do so.
(E) The property rights (other than the intellectual property rights) in a copy of the product or service or in a video compile of its highlights supplied to ZDNet Australia and CeBIT under these terms pass to ZDNet Australia and CeBIT on delivery to us.
(F) We have the right not to make an award if we believe that the standard of entries in a category is not sufficiently high.
(G) The Judging Criteria for the ZDNet Australia and CeBIT 2007 Emerging Technology Innovation Award are:

7. Use of Your Product
If required, you license us to use your product or service in certain limited circumstances.
We will have the right to use the product or service you enter in the Award in the following ways:
(A) Showing excerpts of your product or service at the Awards presentation ceremony;
(B) Using excerpts of your product or service to publicise and promote the Award.
8. Award presentation
The winner of the ZDNet Australia and CeBIT 2007 Emerging Technology Innovation Award will receive a certificate noting this achievement.
Award presentation will take place on the afternoon of the 3rd of May 2007 on the CeBIT Show floor. Entrants and finalists will be invited to attend this presentation through CeBIT 2007 promotion.
9. Use of marks and logos
The finalists in and winner of the ZDNet Australia and CeBIT 2007 Emerging Technology Innovation Award have right to refer to this position and award in their relevant communications collateral.
All references to the ZDNet Australia and CeBIT 2007 Emerging Technology Innovation Award within relevant communications collateral are to be approved by ZDNet Australia and CeBIT prior to distribution.
10. Naming and exclusivity
The award name of ‘The ZDNet Australia and CeBIT 2007 Emerging Technology Innovation Award’ and associated logos, awards / certificates, associated activities including award presentation ceremony, photographic images, video, audio, and associated documentation are the property of ZDNet Australia. Express written permission must be gained from ZDNet Australia prior to any reference to and/or reproduction of this property.
