ACCC applauds court's Boost decision

in brief Australian Competition and Consumer Commission (ACCC) chairman Graeme Samuel has welcomed the Federal Court's false advertising ruling against Optus subsidiary, Boost Tel Pty Ltd.

The competition regulator took Boost to court over claims that the telco was advertising inflated figures around its prepaid call card offerings.

The court ruled that the talk time claim was "false and misleading" and in breach of the Trade Practices Act. It said that the advertised call time was only achievable through one continuous call.

Boost has been ordered to publish a correction notice and to foot the ACCC's court bill.

Samuel reiterated his warning to the telecommunications industry, saying that "the ACCC will continue to play a prominent role in ensuring that all companies accept their responsibilities to provide accurate and easily understood information to consumers".

ZDNet Australia contacted Optus for comment; however, none was provided at the time of publication.
